Terms of Use

Agreement to Terms

By downloading, installing, or using the Lensly iOS application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Lensly ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Eligibility

You must be at least 13 years of age to use Lensly. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Registration

Some features require you to create an account. You are responsible for:

  • Providing accurate and complete registration information.
  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised access to your account.

We reserve the right to terminate accounts that violate these Terms or engage in fraudulent activity.

Subscriptions and Payments

Lensly offers a free tier and a Lensly Pro subscription. Subscriptions are managed through Apple's App Store and subject to Apple's terms and conditions.

  • Free trial: A 7-day free trial is available for new Pro subscribers. Your Apple ID will be charged at the end of the trial period unless you cancel before it expires.
  • Billing: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Cancellation: You may cancel your subscription at any time through Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; no refunds are issued for the unused portion of a period.
  • Price changes: We reserve the right to change subscription prices. We will notify you in advance of any price changes.
  • Refunds: All refund requests must be directed to Apple as the merchant of record. We are unable to process refunds directly.

Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Upload images that are illegal, abusive, obscene, or violate the privacy of others.
  • Attempt to reverse-engineer, decompile, or extract the source code of the App.
  • Use automated means to access or scrape the App or its services.
  • Misuse or abuse AI features, including attempting to circumvent usage limits.
  • Impersonate any person or entity.
  • Transmit viruses, malware, or other harmful code.

AI Features and Accuracy

Lensly's AI features (Scene Analyzer, Photo Tutor, Nearby Spots, Preset Generator) are powered by third-party AI models and are provided for informational and creative assistance purposes only.

AI-generated recommendations — including camera settings, photography advice, and nearby location suggestions — are not guaranteed to be accurate, complete, or appropriate for your specific situation. Always exercise your own judgment when following AI suggestions, particularly when photography involves safety considerations (e.g., shooting near roads, in weather, or in restricted areas).

We are not liable for any loss, damage, or injury arising from reliance on AI-generated content.

User Content

Content you create within the App (gear lists, saved spots, challenge responses) remains yours. By storing this content in Lensly, you grant us a limited licence to store, display, and sync it across your devices for the purpose of providing the service.

Photos you upload to AI features are processed by our AI provider and are not retained by Lensly. You retain all rights to your original images.

Intellectual Property

The App, including its design, code, text, graphics, and all other content (excluding user-uploaded photos), is the exclusive property of Lensly and its licensors, protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

Third-Party Services

The App integrates with third-party services including Supabase, Anthropic, RevenueCat, Open-Meteo, and Apple. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Solar event times, weather data, and AI recommendations are provided for informational purposes and may not be accurate in all circumstances.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LENSLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time via Profile → Delete Account in the App. This will permanently remove your account and associated data.

Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
